Water, Natural Resources, and Environmental Law

Horseshoe Lake - water rights, Arizona water, general adjudication, Gila River adjudication, Little Colorado adjudication, CERCLA, Endangered Species Act, NEPA, natural resourcesI have extensively litigated water right claims in both the Arizona Gila River general stream adjudication, and in the Arizona federal district court under the federal water right decree known as "Globe Equity No. 59," including preparing and briefing appeals and special actions before the Arizona Supreme Court, and the Ninth Circuit Court of Appeals. I am familiar with all aspects of water rights in the state of Arizona, including surface water rights under both state and federal law, subflow issues under state law, and groundwater rights under the Arizona Groundwater Code. I can represent parties with respect to filing, litigating, or settling water right claims in both the Gila River and Little Colorado River general stream adjudications, and developing and presenting expert witness reports and testimony which are usually required. I can also represent you with respect to filing statements of claimant, or applications and permits involving water rights with the Arizona Department of Water Resources; and also can represent you with respect to water right enforcement actions, or water right severances and transfers, and all other matters involving water law and water rights.

I have also represented clients in matters involving natural resource and environmental law under both state and federal laws, including defending the State of Arizona, and state agencies involving CERCLA (Comprehensive Environmental, Response, Compensation, and Liability Act); and have also represented clients in cases involving the (ESA) Endangered Species Act; the Clean Water Act (CWA); and NEPA (National Environmental Protection Act). I have also represented clients in matters involving water quality contamination and pollution, and surface flow and groundwater depletion and pollution caused by well pumping.
